There is a little known secret about your cell phone contract that your wireless service provider doesn't want you to know.

You can cancel whenever you want without paying a termination fee.

Plenty of people have tried arguing with a customer service rep. Some have tried threatening legal action. Others just flat out refuse to pay and several months later find that they are being pursued by a collection agency.
But there actually is a way to terminate your contract early AND avoid the early termination fee. All you have to do is get them to cancel you.

There is a very simple way to do this. Become unprofitable.

If you're paying them $50 a month but costing them a few hundred - They most definitely will cancel you.

So how is it done? A couple of years ago you might of noticed that everyone stopped paying roaming fees. One wireless giant started the "no more roaming charges" program, and the rest followed like the sheep that they are. But just because you are no longer paying the $0.69/min doesn't mean your provider gets off scott free.

Even though you stopped paying for roaming charges years ago, your wireless service provider has been eating the costs. This is done to keep complaints to a minimum, and of course, you as their customer.

So let's do the math.

At $0.69 a minute, a 2 hour long call in a roaming spot just cost your carrier almost $83.00
Even with some of the higher end plans, this would still be quite a hit. But would it be enough to cancel you?

To find out, we just need to take a look at the contract you signed.
This is the link to Cingular's Terms of Service.

It states: "Cingular reserves the right to terminate your service if less than 50% of your usage over three consecutive billing cycles is on Cingular-owned systems. Customer must (1) use a Cingular GSM dual-band handset programmed with Cingular Wireless' preferred roaming database; (2) have a mailing address and live in the immediate geographic area in which subscription is made."

Now, in plain English.
For 3 straight months, make sure that more than half of your calls (51% or more) are done in roaming.

If you've used 400 minutes this month, then you find a roaming spot and place a 401 minute call to MovieFone. Do this on your weekends of course so you don't use your minutes.

After the 1st month you'll know you were successful because you will receive a letter from your carrier suggesting that you switch to a different provider that can better accommodate your cellular needs.

Keep in mind that some roaming partners can take two months to send the records of your roaming calls to your wireless provider. It's possible that your provider won't even know that you were roaming until they receive the bill.

Just for my sake and possibly others I'll mention this: Don't make a 5,000 minute roaming call just because you're mad at your wireless provider. Only use this tool if all other resources have failed you and use it in moderation.

I'm hoping that this information will make termination fees pointless and one day get rid of them altogether.

Also, check with your own provider's contract terms. They may differ. This page is only referencing Cingular.

UPDATE: Wow, this is really taking off on Digg. Just posted this three hours ago and already on the front page.

Some people find it in bad taste to digg to their own blog, but they'll notice I don't have any other entries here to plug. Blogger was used for this bit of information alone due to how quickly it is to create a free page. If google page creator was available, it would of been used instead.

Some other people noticed that it takes quite a bit of time for this cancellation without fees trick to work (3 months). They were able to catch onto this because they have at least a 2nd grade reading level.

Some things they may not of taken into consideration because they only use digg to start flame wars.
1. Where in the world do people come up with this magic number of $150 for a termination fee. You think that just because that's what the sales rep. told you it would be two years ago when you got your phone, that it hasn't jumped up in price without your knowledge? Guess what. It has. Sprint, Cingular, Nextel and Verizon all charge $175-200 now, and they didn't ask you for permission when they changed it. And they still won't ask the next time it goes up.
2. Cellphone Carriers really do have to pay outrageous fees for roaming. $0.69 is the average rate they pay. Av-er-age. This means that some charge more. Like BlueGrass Cellular in Kentucky. They treat their towers like they're made of gold and charge heavily to anyone that crosses their path. Some Verizon customers might remember how up until a year ago they couldn't use their phones anywhere in Kentucky. It's not because Verizon forgot to put towers there. It's because they didn't want you to be on their network one minute, and on bluegrass the next. Verizon instead showed no service in Kentucky on their service maps and wouldn't sign up new customers there until they could strike a deal with bluegrass. In fact, if you look at Verizon's pre-paid maps, there is still no service shown in Kentucky.
3. Wireless providers being billed thousands a month because of one person actually does happen although it is very rare. For most wireless providers it doesn't exceed more than two dozen of their customers per market, but it does happen. Because of this rarity it is merely an afterthought to these giant carriers. But paying more for your customer's roaming fees than what they are paying you each month means you are loosing money on them. Hence, the little known secret to getting out of your plan.
4. Which brings me to one more thing. If your wireless provider cancels you, you do NOT pay a cancellation fee (unless you decided to stop paying your bill and that's why they cancelled you, of course). Unless you request your cancellation, you do not pay. Period. It's as simple as that. Feel free to call your wireless provider right now and ask them that. It's already beyond stupid to advertise a no roaming plan that has so many potential flaws in it for losing money. It's another thing to cancel your subscribers because they actually use it the way you advertise it. And it's just plain mean to charge them a fee after their forced cancellation.
It's not some unproven theory that may work. It does work. It shows it in your contract which there is a picture of just above. (If you're with Cingular)
5. Let's presume that you are the kind of person that can't live without a cell phone. You really hate your wireless provider and want to switch to another company but you know you'll have to pay your last bill plus $175 termination fee all at once.
You're in luck. You just read this blog entry and found a way out. It will take three months, but it's not like you won't be able to use your cell phone like you usually would anyway during that time. And you know that once your done, you'll be able to start fresh with a new company. And most importantly, get the good deals on a cell phone that they only give to new customers.
All you had to do was press a few buttons on your phone to change it over to "roaming only" and make enough calls for your wireless provider to get sick of you and kick you out of their little club.

ya ya ya... but if you go over the 50% roaming with sprint then they will just charge you for roaming even if you have an unlimited roaming plan. dont believe me... call sprint customer service and they will tell you exactly that. i used to work for them

This idea CAN work. No argument on that.

However, the roaming charges carriers pay to each other is not anywhere near what consumers pay. You would be very surprised to know how little they actually pay to each other.

Unfortunately, I cannot back that up with numbers.

Another idea that you can try, if you are desparate to get out of your current plan, is tell the rep that you're moving somewhere where you don't get service. Say something like, you haven't picked the house yet, but you don't get any service in the area. Lots of times, they carriers don't pursue it any further, although they can demand proof.

Another similar tactic is to say you're going on military leave, and again, they sometimes ask for proof, but not always.

I was a customer of AT&T Wireless since they began. Their customer service in my opintion was great! They gave me a new phone every year at no cost. When Cingular bought them it they started sucking! No new phone, long hold times. I was able to get a new phone, but I could only get it at a discount. Well back in the middle of last year I had some service problems and after talking to many people there who had no clue I decided I was going to change carriers. I went with T-Mobile and ported my number. A month later I get a bill from Cingular for an Early Termination Fee for cancelling before my 2-year contract was up. I called them up and said I never agreed to a 2-year or any other contract. I told them if they can show me something in writing that I would be happy to pay. They transferred me to a bunch of other people and finally they said they would waive the fee. They even sent me something in writing saying that the fee was waived.

So..you might want to try this as well. If you don't remember signing a contract agreeing to 1 or more years tell them you want the proof.

Nice idea but I would think this really pointless considering the following.

Since you have to execute this plan over three successive months it seems that you are already spending (monthly fee x 3) to avoid paying the $175 fee. At $50/month you are only saving $25 and are inconvenienced by having to "find" a roaming spot sufficiently heinous enough to piss off your carrier.

Why not just cut and run and go with a provider you are happy with?

A couple of notes re: Sprint...

1. Sprint charges $150 cancellation fee per phone line. We have two lines, so they have been telling us it will cost us $300 to cancel. Having spent hours arguing with their customer service reps in the last few days, I can confirm that this is their current fee for me.

2. Also, roaming is $10/month for me. They don't offer free roaming on my plan. After arguing and complaining for the last eight months, a rep finally gave us free roaming. It didn't help. Then, we got a charge for $10 for the roaming - and claimed that they can't give us free roaming.

Nice info but with one problem, I recently had my phone number ported from one provider to another. I was informed that the account has to be active to do that, so if you wish to retain your number be prepared to suck up the early termination fee.
In my case, I had moved and my provider (Verizon) had no available signal at the new house, so rather than spend $60 a month for the 15 months remaining on the contract it was cheaper to have the number ported to Cingular and pay the $175.

Looking into my crystal ball, I can see their legal beagles rewording the contract to make excessive roaming look like a crime and allow them to charge you a termination fee for the privilege of dumping unprofitable customers.

I can also see them "voluntarily" sharing details on such "deadbeat" customers.

if you are moving to a new carrier,
it is more than $25. because you would pay, lets says, the $175 for the termination fee then you would have to pay the new monthly fee for 3 months on a new carrier, maybe $50/ month sounds like your bill would be $325 in stead of $0. you are paying your bill anyways and using the minutes, if you pay the terminiation fee you don't get the minutes.

This only works if your provider roams. Nationwide networks don't roam. Some carriers own the entire stretch so this wouldn't apply.

funny thing is we actually moved to an area where they have service, but not in our immediate area (too many trees). i told them that and they said "too bad".

so i told them i was moving to cambria, ca (where my mother-in-law lived) where NOBODY gets service. they said "ok" and i was out.

There seems to be some confussion in the comments above about switching providers and taking your number with you.

Paying an early termination fee is NOT part of that process. If you pay that then you've done something wrong.

It's really simple to do. A couple weeks before your current 1 year or 2 year contract is up, go out and sign up with your new service. You get a new phone*, new service and new number. Then when it's all working call up your new provider and tell them to switch your old number over. They will help you with the details. Your old number will be moved over to your new carrier and new phone.

BE SURE TO TELL YOUR OLD CARRIER THAT YOU WILL NOT BE RENEWING YOUR SERVICE. Some require that you do this 30 days in advance. So don't wait until the last minute. Read your contract. But at a minimum you must tell them before the contract is up otherwise it will automatically renew.

*A side note: If you really like your current phone you might be able to convert it over to your new carier. Do a search on "unlocking cell phone" in google to find out if your phone can be unlocked.

I have sprint. Have for years. They own my soul. I am continually annoyed with the poor service and dropped calls. I would leave if it were not for the termination fee. But then again where would I go?

It seems that everybody complains about every provider. Is there one that stands head and shoulders above the rest? I doubt it.

I can only hope that once the growth spurt in the industry settles down, things will get better. Somewhere. For some provider. Then I will find a way to switch!

I am with Cingular and in 2004 spent 6 months in Wyoming where I was doing major roaming. I made 100% of my calls in roaming and didn't hear a peep. By his guestimate I would have cost Cingular around $1400 during that time period. But then again I am on my family's "talk" plan. I wonder if that makes a difference?

Great idea if you are stuck in a contract. I sell phone so I have some insight. I just have a few points that might clear up some confution. First of all if you are try to save money it would be better to pay the $150-$200 fee than deal with bad service at $50 a month for 3-4 months! Another way to get out of a contract (I have had customers do this with verizon and other) remember they are a "service provider" so if you don't have service at your house they will let you out of your contract, find a tell them you live in the basement and have no service or find a friend house where you phone don't work and change your bill address to there and ask them you let you out because of no servise. The problem with the roming fee loop hole is if they cancell, you might loos your number! ALSO I'AM SO TIRED TO PEOPLE COMPLANING THAT THEY HAVE TO PAY $200+ BECAUSE THEY WANT A NEW PHONE BEFORE THEY TIME FOR UPGRADE. Cell phones is the only industry I can think of that sell the products way under cost to get people to buy(like hp giving away printers for free, but charging $50 for ink) Think how the cell companys offer a "free phone" do you really think that mini computer with a color screen, camera, mp3 player really didn't cost anything? NO! it cost $200-$300, but they give it to you for free because they know in they long run they'll make up for it. If you came in every month or two and got a new $200 phone for free they would be losing mony!

So if you get them to cancel you? Will they then let you set up a new contract? They only let you change your phone once a year unless you want to pay $$$$. This might be a way to break out of that. I will have to look into it more closely.

That's why the cellphone companies have the early termination fee, you moron, to cover the cost of the cheap cellphone they give to new customers who cancel their contract early.

Over the course of 1 or 2 years (the length of the typical contract commitment), the phone will get paid for by the profits they make on a user's account. If the user cancels after 2 months, the provider has lost money on giving the user a cheap phone and they need to recoup the money somehow: thus the early termination fee.

It's simple economics. It isn't a made-up fee to irritate people, it's the price people pay for not paying for their phone over time as they agreed to do by signing the contract.

If they called it the "Handset Buyout Fee" instead of the "Early Termination Fee" would you be more inclined to just pay it?

there is the option to not have a contract when signing up right? they can give free phones and lower rates if they can guarantee business for a certain time... that's why the 0, 1, and 2 year contracts have difference prices/features.

or maybe i'm wrong and you have to have at least a 1 year contract when signing up? i haven't gotten new phone service in a long time...

I have Nextel (now Sprint), and I am in a dispute with them about my contract date. I asked for a copy and they said that all of thier contracts are "verbal". I switch plans 1.5 years ago, and I guess my nextel rep did not tell me that commited me to two more years. I told them if they can show me the contract there's no way they could hold me to it. Also, they made a mistake and one of my phones had a more recent contract end date by six months, and I argued that the mistake was the later date, and after talking to three people and getting the "Internet Help Desk" treatment" they changed the date to the better date.

Verizon buys out contracts if you switch to their service before you contract ends with a competing carrier.

Not sure if other providers buy contracts out, but if you're making a switch and don't want to pay an early termination fee go w/ Verizon.

With Cingular, I have been outside of my home area and roaming for the past 12 months (I moved to the other coast and never switched my account) and have never received a letter or warning, etc. And I know people who have lived outside of their home calling area for a lot longer than that without notice from their carrier.
I finally just switched to Verizon, even though I still had to pay a termination fee.

And to think, it's only a minority of unwise consumers who don't pay their bills (or any other bills for that matter), they complain and refuse to do anything to improve their situation. Sounds like a personal problem, not a cell phone problem. ;)

Speaking of mis-informed, Cingular maybe the most popular but they aren't the big dog on the block anymore.. you should do your homework.

Cellular providers have early termination fees for a reason. That reason is not necessarily to "screw" the customer as some of ou seem to think. If they did not have the fee,people would be cancelling and changing their plans all the time. It would be a major hassle for the company. Sometimes rules are frustrating to but they are for a purpose. If everyone thought the way some of you people do, our wireless service would probably ending up being more expensive than it is now. They give us unlimited night and weekends, no roaming, good reception mos of the time, a new cool phone every two years and yet for some that is not good enough. Some of you think they should just lose money and give us everything we want. We sign a contract in good faith, which means we have to exhibit good faith also. It is a two way propostion.

if you agree to honor a contract in writing, why would you go thru all this 'manipulation' to be cancelled. sounds pretty cheesy to me what u r advocating! But, maybe I don't understand.

Also, I don't know what's in my contract, but, I am sure there is a section where I am liable for the roaming charges, so why would i want to take the chance of getting sued to have to pay for 100's of minutes I purposely called a moviefone and used up?

i am every bit for consumer protection as I am a consumer who speaks up if i feel i am not being treated correctly. however, as a business owner myself, i take offense with what u are doing.

Well if i thought it would work,i'd try it. I have two verizon phones an its double charge for early cancelation,though i have only ONE account. Sounds like a rip off to me what do you think? I think if your not happy with any service for a real reason,like extremely poor service ect. the provider should provide you with some cash back or a compromise.

not all cell phone services give you free phones. I signed a 2 year contract with unicel a year ago and I still have a $175 cancellation fee in my contract even though I payed $99 for a 3-4 year old cell phone model (the motorola v90 in boring black and white). They're lying if they tell you the phones cost more than that. Cell phone companies exist purely to rip consumers off. So I say f*** 'em!

They promised her that it would work at her house which is in the country. So, she goes home and you guessed it it didn't work. She went called Nextel and they were sorry but there was nothing they could do about it and made her pay the $200.00 cancelation fee. I couldn't believe they did it. Nextel is so expensive. That is my carrier but I am locked into them for 2 more years.

Re: Nextel/Sprint's "verbal contracts"

IF there is no contract in writing that YOU THE CUSTOMER have signed, no cell company can hold you to more than a 1-year term. This is because of the Statute of Frauds that each state has. Contracts that cannot by their terms be performed in one year or less must be in writing to be enforceable.

If you're with Cingular and only want out of your contract so you can get a free new phone, it is now possible to do a contract extension and get a new phone free - even a RAZR. You must be at least 10 months in to the 12 month contract or 22 months in to your 24 month contract to qualify for a contract extention and phones are only free after rebates, but if you're interested, check out EasyCall Cellular for more information.

Most cellphone providers have a pay as you go service. While you may pay a little more per month there's no deposit and no contract problems when you want to switch carriers. I have a gophone with Cingular now and it's not bad at all, I know sprint and t-mobile have similar plans.

I moved from OH to MT w/ my cingular phone and was unaware of the 50% rule (it's not in my paper contract - I could only find it online). And it seems to me that all of the customer service reps I spoke with up until today do not know about this rule, or aren't allowed to talk about it - as they let me add a line when I explained that I believed all my calls are off-network. Last week Cingular sent a notice to my former OH address (they've had a difficult time processing the fact that I moved to MT) that I had exceeded the 50% off-network calls. I spoke with a rep this morning and she told me the letter is a heads-up, they will terminate the contract if I continue to exceed the 50% rule, but she also offered to cancel my contract on the spot for free as I explained that I will always be off network where I live now. She explained that I will not be charged any roaming fees, as I am on a Nation plan. She also could not tell me a date or the lenght of time at which Cingular would require that my contract be terminated. I have been making 100% off-network calls for over 3 consecutive months. Also, there is no way, at least with my phone and up until last week, that you can tell you are off-network. "Cingular" will always appear on the phone, even when you are roaming. As I was informed in the letter, they have changed the "Cingular" that normally shows up on the display to foreign characters to let me know that I am off-network (I thought the phone was malfunctioning for a few days). I haven't seen this letter myself, my mother read it to me over the phone, and it stated things like "this is no one's fault" and "this policy affects less than 1% of cingular customers."

I used to (emphasis on used to) work for AT&T Wireless and I'll back up what dirtvoyles said....the carriers pay a lot less in roaming than what we pay. But none of them charge $.69 a minute for roaming anymore either. Actually coverage has improved significantly across all carriers since the $.69 a minute days and roaming should be minimal for all of them. But they all have roaming agreements with other carriers. They have to to be able to provide the coverage they do.

As for the early termination fee....it'll always be around because the price that we all pay for phones is a lot less than what the carriers pay the manufacturers. So they have to have to way to get their money back on the difference(either ETF or through 2 years of margin on the service) since they're in business to make money not as nonprofits.

The key was, that she said she absolutely could not waive the ETF no matter what.
BUT, she could easily post a credit to my account for the exact same amount as the ETF. werks for me!!!!

Worse yet my carrier, centennial wireless says they will charge their early termination fee of $250 per active phone number on an account reguardless of how the service is terminated, even if it is their choice. It is stated here:

Great comments on getting out of a Cell phone Contract. The issue I have is if the phone is free to me for signing the contract and it is my phone how can they keep it locked? I understand durring the length of the contract but if they transfer it to being my property---I'm sure they no longer claim it because then they would have to pay the local state property taxes on it. That might be an interesting angle to get the cell companies to quit locking their phones---get your state legislature to make them pay the property taxes on it.

It is really kinda interesting the Contract that most companies make you sign. They can change it to their benefit and not let you out of it.

My sons phone the text messaging charge was raised durring the contract time. He didn't keep the contract so he had no way to fight with them.

I am an avid believer in prepaid cell phones. I would rather buy the phone upfront and then be free to use it when I want. The new Alltel U Prepaid phone service is really good for unlimited texting or unlimited phone calls to one number or several different options.

Thanks for your advice. I live in a Non-Cingular area due to the stupid city planning committee that only wants small time Alltel and Cellular One here because their buddies own stores here so the FCC antitrust laws keep them out. I have an 816(KC) cingular number in this non-Cingular town of Fort Scott. But I have 2 other phones that are used just as much as mine in a Cingular area town just 20 miles from me. People in town here say that Cingular said they would drop them on July 4th. Cingular apparently called them or wrote them a letter. I haven't received either. Do you think I should worry about it? Especially since I have 2 other (family talk) phones used in a Cingular town?

There is so much useful information here. Verizon just let me out of 2 of my contracts due to connectivity issues. No ETF!

No more running outside to keep a connection long enough to tell clients I will call them right back from a land-line!

In April 2005 Verizon sales reps promised I would have better service once they upgraded their towers to be "all digital" by June/July 2005. I purchased 2 more phones for my exchange students and waited for this "better reception". Then, my service got worse because my digital phones had trouble connecting to the 1 analog tower near my home.

This spring AT$T put a repeater near my home, then my marginal service dropped to almost no connection.

I nicely complained all the time. Customer care has a loooong history regarding my connection issues.

Before you try to get out of your contract for having poor connection, complain about it. Frequently. Some companies do put repeaters in areas with high complaint calls. If not, your history is proof of not being able to use a phone that you pay for.

1. If another cellular company puts a "repeater" near your home, it could interfere with your service. (Verizon verified this happened to me.)
2. If you live in a "marginal area", have the technical department come to your home to check your coverage. (Verizon wont guarantee connection in the home) If it is "marginal" have them add this notation to your account for the Customer Service Reps to see.
3. DONT USE YOUR CELL PHONE, or lower your usage when you are not at home. It helps to show a drop off in your minutes. (they had NO arguments, because we had 0 minutes for 2 months on 2 phones)

DO be honest. A contract is a contract. If companies are not able to provide you with the service you pay for, most will accomodate you.

If your situation is about $$ and not service: I had a friend who could not afford her phone any longer. She explained her situation to a manager and offered to pay $60 to get out of her contract. The T-mobile manager offered her a "credit" to her account after the ETF was charged. This left her with a balance was $50. Sometimes honesty is best.

Roaming charges paid for by Carriers are typically about 10 cents per minute domestically. This is especially true for Cingular as I have worked there in the past. International roaming is even more of a rip off. Cingular typically pays 3 cents a minute for Roaming in India, but charges customers up to $2.99 per minute. (The UK charges Cingular about 55 cents per minute)

for those of you that are furstrated about not being able to upgrade your phones or getting lousy discounts through your providers, here is a solution. those of you that live near "costco" you can purchase your phone at full retail cost, use the phone as long as you like then return the phone and get a full refund. with the money you should be able to buy the next best thing and use it until u get tired of it again. this solution will get you a new phone every 6 months with no or very little out of pocket expense. i know a couple people that have been doing for the past 4 years.

hi. i googled "cingular early termination" because i was hoping to find something like your post. i have a question. i have four phones on a family plan. they have been costing me about $170 per month, and the coverage is stinky because 3 of the four of us have moved since we got our phones, and although we get service, it is bouncing off another carrier and causes problems like having to stand by a certain window while talking in order to not get a dropped call. one of my kids started working for sprint last year and can get us all phones with service for $15.00. this was too good to pass up. i stopped paying cingular, let the bill get overdue, they suspended my service. i called them today to tell them that i would be willing to pay the accumulated bill, but do not want to pay the early termination fee. the bill is $650.00 as of today. they said i would have to pay that portion of the bill before they would discuss waiving the early ltermination fees ($175.00 x 4).

i am uncomfortable paying the $650 because the way i see it, if i pay that and then they say i still owe for the termination fee, they have my proverbial tits in a wringer.

any advice?

Cell phone companies suck in general. But dammit I can't live w/ out my cell phone. I soooo thought about doing this whole roaming thing. I'll probably just pay the cancellation fee and start over w/ a new company. We have 5 phones on our family plan. Kids want a new phone anyway! :)

I have been with 3 different cell phone providers Sprint Wireless then went to Nextel before SPrint destroyed them and then to Cingular. I have been with Cingular now the so called new AT&T Wireless for 4+ years have 3 phones on my account. When I started with Cingular I had great service and no problems. As soon as they bought out AT&T Wireless and started to turn off towers my service went south over months to the point I have no service at my home not even roaming also a drastic increase in dropped calls. I have had techs sign and document that there is limited to no service in my area and still the NEW AT&T refuses to let me out of my contract. I have done the 3+ months on roaming no warning nothing. I also took the Verizon challenge and had great service at my home and less dropped calls. I told AT&T I did not want to renew my contract sent them a certified letter to document this request and they still renewed my contract. I would have thought that a so called reputable company as AT&T would honor a request to not extend the contract but was incorrect. AT&T and most of the rest are not reputable companies most of them are owned by other companies outside of the USA. Just my 2 cents worth wait the excise tax has been added so that is $100.02 now. It's simple economics. It isn't a made-up fee to irritate people, it's the price people pay for not paying for their phone over time as they agreed to do by signing the contract.

Real nice with the "moron" comment. I think most people realize what these charges are about. And yes, I do think it would be better to call the fees what they are--"Cover the cost of that expensive phone we gave you fee". What I wish the companies would do is simply charge a reasonable profit on the phones up front, make the phones compatible with all networks, and no contracts. This way, they don't lose money on the phones and consumers don't get screwed by crappy service. The way it is now, you can pay your termination fee, but you may end up with a useless $300 phone that can not be used with your new service provider.

I had an unlimited roaming contract. I moved to a roaming area and used thousands of minutes all in roam. I did this for two years. I tried to move carriers, but they wouldn't let me out of my contract.

I called my provider this morning to cancel because my service sucks where I just moved to. They said if I can prove I moved somewhere that their service is lacking they would waive the fee. I have just moved to Atlanta so there's no way AT&T is going to admit their service sucks here.

I then pulled out the "OK, show me where I signed agreeing to an early termination fee". They can't. The rep tried throwing legal jargon at me -- verbal contract, my responsibility to keep the contract because they don't, etc. etc. She wasn't any help.

I told them to cancel me. I'll fight the termination charge when it arrives on the bill because I don't recall signing anything to that effect, and they can't prove that I did.

We've been with T-mobile for almost five years and for the most part been pretty happy with them and there customer service till now. I'm disabled in a wheelchair and due to health issues spend alot of time in bed so for health and safety (especially when I'm out in my chair) reasons depend on my cell phone therefore it would be nice if the phone would work more than 8 months and it would of also been nice when the store agreed it would send me another phone it would of lasted more than 7months before it had a major defect and requires me to get another phone. Evidently I was suppost to know the "new" phone was refurbished and did not come with a new warrenty because the store didn't tell me this (If they had I would of gone in a different direction. what really gets me is when I tried to reason with the supervisor because i can't afford to pay for new phone now he suggested I look at other carriers knowing we have atleast a year left on our contract!!I like your suggestion because I definitly can't afford to cancel and he was so smug when he suggested it. Unfortunantly I wouldn't know where to call from that would cause roaming. Anyway I just hate it when someone has you at a disadvantage and act like a jerk about it.

While you may pay a little more per month there's no deposit and no contract problems when you want to switch carriers. I have a gophone with Cingular now and it's not bad at all, I know sprint and t-mobile have similar plans.
